By accessing and using the services provided by PBJ Infra ("Company," "we," "our," or "us"), you ("Client," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

PBJ Infra provides construction and infrastructure development services including but not limited to:

  • Swimming pool construction and design
  • Resort and hospitality construction
  • Waterpark development
  • Farmhouse and residential construction
  • Ferro concrete design and construction
  • Pool maintenance and filtration services
  • Land development services

3. Project Agreements

3.1 Contracts

All construction projects require a separate written contract that will include:

  • Detailed project specifications
  • Timeline and milestones
  • Payment terms and schedule
  • Materials and labor specifications
  • Warranty information

3.2 Estimates and Quotes

All estimates and quotes are valid for 30 days unless otherwise specified. Final pricing may vary based on site conditions, material costs, and project modifications.

4. Payment Terms

4.1 Payment Schedule

Payment terms will be specified in individual project contracts. Typically:

  • Initial deposit: 20-30% upon contract signing
  • Progress payments: As per project milestones
  • Final payment: Upon project completion and approval

4.2 Late Payments

Late payments may incur interest charges of 1.5% per month or the maximum allowed by law. Work may be suspended for overdue payments exceeding 15 days.

5. Project Timeline

Project timelines are estimates based on normal working conditions. Delays may occur due to:

  • Weather conditions
  • Permit delays
  • Material availability
  • Client-requested changes
  • Unforeseen site conditions

We will communicate any delays promptly and work to minimize their impact.

6. Change Orders

Any changes to the original project scope must be documented in writing and signed by both parties. Change orders may affect:

  • Project cost
  • Timeline
  • Material specifications
  • Warranty terms

7. Warranties

7.1 Structural Warranty

We provide a 5-year warranty on structural work against defects in materials and workmanship under normal use conditions.

7.2 Equipment Warranty

Equipment warranties are provided by manufacturers. We offer a 2-year warranty on installation and integration of equipment.

7.3 Warranty Exclusions

Warranties do not cover:

  • Normal wear and tear
  • Damage due to misuse or neglect
  • Acts of nature or force majeure
  • Modifications by others
  • Failure to follow maintenance guidelines

8. Client Responsibilities

Clients are responsible for:

  • Providing accurate site information
  • Obtaining necessary permits (unless specified otherwise)
  • Ensuring site access for workers and equipment
  • Making timely payments as per contract
  • Following maintenance guidelines
  • Notifying us of any concerns promptly

9. Safety and Compliance

We are committed to maintaining the highest safety standards and comply with all applicable building codes and regulations. Clients must:

  • Keep work areas clear of personal belongings
  • Restrict access to construction zones
  • Follow safety instructions from our team
  • Report any safety concerns immediately

10. Limitation of Liability

Our liability is limited to the contract value of the specific project. We are not liable for:

  • Indirect or consequential damages
  • Loss of use or enjoyment
  • Economic losses beyond contract value
  • Damages caused by third parties

11. Insurance

PBJ Infra maintains comprehensive insurance coverage including:

  • General liability insurance
  • Workers' compensation
  • Professional indemnity
  • Equipment and materials coverage

12. Dispute Resolution

Any disputes arising from our services will be resolved through:

  1. Direct negotiation between parties
  2. Mediation by a neutral third party
  3. Arbitration under Indian Arbitration laws
  4. Legal proceedings in Pune jurisdiction

13. Intellectual Property

All designs, plans, and proprietary methods remain the intellectual property of PBJ Infra. Clients receive a license to use designs for their specific project only.

14. Termination

Either party may terminate the contract with written notice. Termination terms will be as specified in individual project contracts, including payment for work completed and materials ordered.

15. Force Majeure

We are not liable for delays or failures due to circumstances beyond our control, including natural disasters, government actions, labor strikes, or material shortages.

16. Governing Law

These terms are governed by the laws of India and the state of Maharashtra. Any legal proceedings will be conducted in the courts of Pune.

17. Modifications

We reserve the right to modify these terms at any time. Updated terms will be posted on our website with the revision date. Continued use of our services constitutes acceptance of modified terms.
